This thread IS NOT about if porn is good or bad it is about First Amendment Rights Arguments.
Why is it the city library can allow porn to be viewed but a private citizens can't?
Any post about if porn is (good or bad) will be deleted.


If the library can allow porn why can't a local business have a stripper or an adult sex store?:new_shocked:
Very good question (sew) !!!! I think this question would or has open up a whole new can of worms.

Why would someone not be able to setup an adult store charge admission to the store but watching porn on a computer monitor is free? ( Library?? )

Or,

What is the difference.
(1) Someone opens an adult movie theater charges for admission just like the regular theater.
(2) The library charges the tax payer to operator, then allows porn to be viewed.

Can't wait to see where this thread goes.

Interesting ... there are only TWO reasons a city council can vote down a liquor license: Being too close to a church or school (300 feet), or "moral turpitude." Otherwise, the council has no choice in the matter, since it's a state license, even though the council likes to "act" like they're making some kind of major decision on the matter.

So, an establishment that wanted to have topless servers for instance, would be stopped by the city council - but a minor child - who couldn't enter that establishment anyway, mind you - can sit at a computer at the public library and be exposed to hard-core porn...

Duplicity has a name - it's called the Roswell City Council!!

Why not put up a raunchy billboard with filthy pictures? Welcome to Roswell alien porn on the Pecos is our motto! If it is a free speech issue then the billboard should be perfectly legal. No?

I think this thread kinda diverged from its original title..

What does everyone think about Area 420 not being allowed to sell adult objects and material to adults?

I'm sure the operators of that adult place just north of Artesia are just tickled pink about it..

A few years back Roswell enacted a "descency law" that this falls under, I believe. I was working @ Hastings when it was in the mall and when I opened the store one morning the cops and a few officials came rolling in on a mission. They tried to arrest me for peddling porn in magazine form. I was 19 years old at the time and could do absolutely nothing but laugh. Made a call to corporate and 20 minutes later they all left.

I think this stuff is worded so it can be up to interpretation.

Kinda like Roswell's old sound ordinance. I got pulled over for having a loud car stereo. I sold this stuff so I always had the latest and greatest running. Anyways...I get pulled over and issued a citation. Went to court and pled not guilty. When asked how I could plead not guilty when I could be heard from 2 blocks away I asked what the actual "sound limit" was? City attourney had no answer as there was none. It's all up to whomever is the "decider" at the moment. That doesn't hold up in a court of law.

If these merchants want to spend the time in court I am willing to bet they would win. Then of corse the law would be rewritten.
